Terms and Conditions

By registering and placing an order on ArtZest you acknowledge that you are bound by the terms and conditions listed below:

  1. The artworks made available for sale on the Website are not always in the physical possession of ArtZest and can be physically located in the artist's studio.

  2. All artworks made available for sale on the Website will be sold at the price listed and no discounts will be granted to the buyer. The price of the art work listed does not include duties and taxes. The buyer agrees that the buyer is liable for any duties and taxes that might be applicable on the purchase and such charges shall be payable in addition to the price of the artwork.

  3. The paintings that are unframed & unmounted will be shipped in a rolled format & in protective cylinders. For the paintings that are shipped with glass frames, we cannot provide any guarantee for the Glass, though utmost care is taken while packing.

  4. The information provided during registration or amended at the time of finalizing a purchase shall be the final billing address and shipping address for delivery of the artworks.

  5. All invoices will be raised by ArtZest based on the registration information provided by the buyer or amended at the time of finalizing a purchase and payments will be accepted only from the buyer so registered. In the event that a payment is sent from elsewhere, it may either be returned or could result in a delay in the processing of the order until management decides whether a variation from the registration details may be accepted.

  6. Placing an order on ArtZest constitutes an irrevocable acceptance of the purchase. Unless rescinded/cancelled by the Art Gallery within 2 working days on account of a default by the seller or any prior or continuing breach by the buyer, such acceptance results in an enforceable contact of sale. The contract of sale is between ArtZest (acting as the agent of the Seller) and the buyer.

  7. All sales are against 100% payment in advance.

  8. Once an order is placed on ArtZest the buyer is required to make payment for the price of the artwork as well as the charges referred to above within 5 working days from the date of placing the order. In the event that ArtZest does not receive payment within 5 working days it reserves the right to cancel the order without prior notice to the buyer. Alternately, and without prejudice to the foregoing, ArtZest may, at its absolute discretion, hold the artwork for the Buyer and charge any storage and insurance costs applicable on the purchase and/or may seek to commence legal proceedings (acting as the agent of the Seller) to ensure execution of the contract of sale.

  9. The artworks will be delivered/shipped to the Buyer directly by the Artist/Gallery through a courier of good repute. Should there be any damage to the artwork in transit the Buyer should not accept the parcel and should notify ArtZest immediately.

  10. If the product is damaged when it reaches you (please note that ArtZest does not insure frames if the painting is in the framed form). If you have received a damaged product, exceptions should be noted immediately on the Airway Bill copy to be retained by the courier shipping company and by yourself. Please also make appropriate remarks on the delivery sheet of the concerned courier company personnel making the delivery and inform ArtZest immediately by sending us email at artzest.ae@gmail.comHowever, the unsatisfactory condition will only be covered for damaged or spoilt condition, and NOT because the buyer did not like the artwork he has purchased.

  11. You agree to abide by all provisions prescribed in these terms and conditions. In particular, you warrant that all information that you submit will be true and accurate (including without limitation your credit card number and expiration date), and you agree to pay all costs, charges plus all applicable taxes for the purchases made by you.

  12. The dispatch will be done within 15 days of confirmed receipt of the full value of the shipment. Orders where payment is Internet/Bank net transfer, PayPal etc will be shipped only after clearance of the same

  13. ArtZest is authorized by the Sellers to exercise complete discretion in (i) the illustration and descriptions of art works for viewing and sale and (ii) acceptance or rejection of orders received.

  14. All artwork displayed on the Website is supported by an authenticity guarantee from the Seller.

  15. All works showcased on the website are original works of art other than the ones that have been clearly marked as reproductions and have been certified so by the artist. However in case it coming to light that a certain work of art is a copy of another existing work, ArtZest disclaims any liability for the same.

  16. While great care is taken to depict the true colors of paintings as on the website, there may be variations in shade and color due to screen settings. No complaints in this regard would be entertained.

  17. ArtZest is not obligated to provide any physical preview of the artwork either before or after the sale. ArtZest is in no way liable for the condition of the artwork.

  18. All prices are mentioned in dollars since we are an international platform. The prices for individual artworks have been 'rounded off' for ease of reference and do not necessarily reflect the exact exchange rate that will be used for calculation of the invoiced price.

  19. The buyer warrants that all the information furnished at the time of registration is true and correct and any change in the information provided will be updated and intimated to ArtZest immediately. ArtZest is entitled to act on the basis of the information provided and seek such further information, clarifications or verifications as it may deem necessary for granting registration. Such registration may be suspended or cancelled where ArtZest forms a reasonable view that any of the above information may be inaccurate. However, such registration will be restored immediately on the buyer furnishing information to the satisfaction ArtZest.

  20. Please refer to the Disclaimer and the terms of our Privacy Policy, which together with these terms and conditions govern your use of the website.

  21. These terms and conditions are governed by the laws of England and Wales and any dispute connected with this site is subject to the exclusive jurisdiction of the English courts. ArtZest may change these terms and conditions from time to time. We shall try to notify visitors to the site of any material changes, but you are advised to check back from time to time to confirm the latest version; you will be bound by changes even if you do not revisit this page to check for any updates.

  22. By registering with ArtZest, you guarantee that you are at least 18 years old and that the information you supply is true and accurate; you agree to notify us as soon as possible of any changes by email. You may request that ArtZest stop using your information to send you the Art email newsletter. By registering, you also agree that you are responsible for your account security, your password and any activities on your account. You agree to notify us of any unauthorised use of your name or password that comes to your attention. ArtZest cannot be held responsible if you do not protect your password or account.

Returns & Refunds

The artworks will be delivered/shipped to the Buyer directly by the Artist/Gallery through a courier of good repute. Should there be any damage to the artwork in transit the Buyer should not accept the parcel and should notify Artzest immediately via email.

Artworks received in an unsatisfactory condition by the buyer may be returned to the Artist/Gallery within maximum 14 working days in an ‘as is’ condition. In such a case Artzest will refund the payment to the buyer and cancel the order. However, the unsatisfactory condition will only be covered for damaged or spoilt condition, and NOT because the buyer did not like the artwork he has purchased.

In the case of faulty or damaged items, if you don’t inform us within 14 working days of delivery of the item, we will deem you to have accepted them and will not accept a return. They must also have been stored in appropriate conditions; if you are unsure of these, please email us at artzest.ae@gmail.com.The goods returned must be securely wrapped and include complete delivery address after confirming & accepting the return.

The goods are returned at your risk and cost.

When the artist or gallery receives the goods we will credit your debit or credit card with the full purchase price. Please allow up to 28 days from the day we receive the returned goods for refunds to be processed.

If the goods are not returned you are liable to us for the cost.

We are not obligated to collect goods from you.

Delivery Info

Artwork will be dispatched within 14 working days of confirmed receipt of the full value of the shipment. Orders were payment is Internet bank/Net transfer, Paypal etc will be shipped only after clearance of the same.

We will send  an email to the address you provided on registration (as may be updated) when your order has been dispatched, including any information on how to track your order.

ArtZest does not accept any liability for failure or delay in delivering goods or for any damage or defect to goods, in each case, that is caused by any event or circumstance beyond its reasonable control.

All orders are shipped out via reputed courier services, for all International deliveries, upon the delivery reaching the destination country this will then be handed and delivered by your national postal service. Please be aware that sometimes deliveries may be subject to customs clearance which we have no control over which could cause a delay to you receiving your parcel.  We reserve the right to change this restrictions from time to time.

We currently offer an International Delivery Service to a number of countries such as Europe, USA, Canada, New Zealand, Australia,India,Pakistan,United Arab Emirates and many more.

Unfortunately due to individual country custom requirements we currently do not deliver to the following destinations

  • Vatican City State
  • Andorra
  • Canary Islands
  • Gibraltar
  • Iceland
  • San Marino
  • Greenland

We apologise in advance for any inconvenience caused.

All orders will be via a trackable service. If your order has not arrived within the given delivery guidelines to your country please contact your postal service. Alternatively you can contact us and we will try and assist.To avoid packages being sent back to us please contact us or the delivery company within 5 days of the delivery guideline being surpassed without delivery of your order.
